General Terms and Conditions governing the relationship between the Nominator, Nominee and NBF

Introduction
The "NAMMA BENGALURU AWARDS" (hereinafter referred to as "Awards") are being organized by Namma Bengaluru Foundation ("NBF"), having its registered office at NA Chambers, # 3J, 7th C Main, 3rd Cross, Kormangala 3rd Block, Bangalore – 560034. These Awards are being organized in pursuance of a social objective and is not organized for business purposes or monetary gain. The sole basis to determine the recipients of these Awards is principles of social service. Therefore, the basis of the Awards is not construable as a “lottery” in any sense.

In consideration of social recognition by the receipt of Awards, you agree that the Terms and Conditions contained herein (the “Terms and Conditions”) form an agreement regulating your relationship and participation in the Awards. You are advised to read the Terms and Conditions carefully. If you are not agreeable to any Terms and Conditions, you should not use the www.nammabengaluruawards.org /www.namma-bengaluru.org or file a nomination or participate in the Awards in any such other manner. If you use the Site or file a nomination or participate in the Awards in any such other manner as outlined in these Terms and Conditions, you shall be accepting these Terms and Conditions unequivocally and unconditionally in their entirety and these Terms and Conditions will be a legally binding agreement between you and the NBF. You shall be bound by the Terms and Conditions which shall remain valid, binding and in force till the present Awards process is complete/over and till the next Awards are declared.

These Terms of Use ("Terms") constitute a legally binding agreement between you and Namma Bengaluru Foundation which govern your use of their websites and micro-sites. These Terms may be updated by NBF from time to time and you should periodically review the most up to date versions. NBF may at its sole discretion and without prior notice modify or revise these Terms and Conditions and policies and you unequivocally agree to be bound by these modifications or revisions. You agree to access the Site or file a nomination, subject to acceptance of the Terms and Conditions of use as set out here to the extent applicable. If you do not agree with these Terms, please do not use the site or file a nomination.

Nothing in these Terms and Conditions shall be deemed to confer any rights or benefits to a third party. The disclosures made by you on the website and in the application form shall be true and correct and the same shall be relied upon for the purposes of evaluating the entry.

NBF reserves the sole right to terminate the Awards or determine the validity period of the Awards at its sole discretion.
Receipt of entries

The following process will be performed by a team designated by NBF and supervised by senior NBF staff prior to deliberation by Jury. It is not expected that any qualitative evaluation of the forms is performed at this stage.
> Nominations received on earlier occasions for these awards will not be considered for the current year. Fresh nominations may be made to participate in the
    Awards for 2016.
> The awards management team will not be responsible for application forms that are lost in transit / received late. Entries that are received after last date of specified for such receipt may be permitted only at the discretion of the awards management.
> More than 1 nomination against a single sub – category may be provided by any particular nominator. However, for evaluation purposes they must be on separate
   nomination forms.
> Candidates must be nominated by atleast 1 nominator for the purpose of consideration by the jury. The number of nominations has no bearing on the outcome –
   only the quality of the work done by the nominee as evaluated against evaluation criteria is under consideration by the jury.
>The awards management reserves the right to consider a nomination under a new category or sub category other than that specified by the nominator based
   on the facts available. This may be done in the event no category or sub category has been selected in the nomination form.
> Application to the awards will be construed as an acceptance of the Terms and Conditions and the application form signed by the applicants would signify
   their acceptance of these Terms and Conditions.
> The jury may decide to award more than 1 candidate for under any of the sub-categories above or a new category altogether and the decision of the jury
   will be final in this regard.
> Award categories may be changed / modified / increased or reduced / cancelled based on the level of responses received, at the discretion of the awards
   management.
Disqualification process

> No form of canvassing for candidates will be permitted and any such effort will disqualify the nominee.
> No correspondence will be entertained regarding the selection of the awardees or the selection procedure.
> Incomplete nomination forms are subject to disqualification.
> Nominees may not be trustees and employees of NBF or its associated institutions and Companies, Jury Members, employees of KPMG in India and its
   associated firms. NBF and Jury Members will be responsible to indicate their association with nominees under consideration or any potential conflicts of interest
   and jury shall deliberate any risk emanating there-from. Jury will decide on a suitable course of action to evaluate such nominations including but not limited to
   outright disqualification or suitably excluding interested members from deliberations. Decision of jury will be final and binding in all such cases. The Jury also
   reserves the right to disqualify any person or institution for due cause and any decision in this regard will be final and binding on all including NBF.
Selection of winners

> The jury will have the sole right to select the winners of this award in accordance with the objective, eligibility criteria and the selection criteria set by the Awards
   management who may formulate rules in this regard.
> The decision of the awards management on all matters is final and binding on all nominators and nominees and no correspondence will be entertained
   on the same.
> Awardees shall be contacted either by post or through email or telephone and through selected newspaper announcements.
> NBF reserves the right to perform a due diligence / audit of the nomination to seek further facts for the purpose of consideration by the jury. The decision of NBF
   and / or the jury based upon the due diligence report / certificate or otherwise shall be final and binding upon the applicant / nominator and no correspondence
   shall be entertained in this regard. Any false representation shall entail summary disqualification.
> NBF shall not be liable in any manner whatsoever as a consequence of discovery of misrepresentation or falsity in submission of information/details/ disclosures
   by the nominator at any stage whether when the process of Awards is on or after the Awards have been declared.
Disclaimers and release from liability

You understand and agree that NBF shall carry out the Awards on an 'as-is,' 'with all faults' and 'as available' basis. No representations, warranties or guarantees whatsoever are made by NBF any of its vendors including the process validators as to the accuracy, adequacy, reliability, completeness, suitability or applicability of the information to a particular situation or that the Awards or Awards Process will be uninterrupted or error – free or that any errors will be corrected.

To the fullest extent permitted by law, NBF, its trustees, officers, directors, employees, agents and vendors disclaim all warranties, express or implied, in connection with the awards and the process of nomination and selection. You should use your best judgment and exercise caution where appropriate.

You hereby agree and undertake not to hold NBF and/or or any of its affiliates, their respective directors, officers, employees, agents, vendors, process validators responsible for or liable for, any actions, claims, demands, losses, damages, costs, charges and expenses that you may/might have suffered, sustained or incurred, or claims to suffer, sustain or incur, by way of and /or on account of applying for or participation in the Awards.

You waive your right, either individually and/or severally, to file in person and/or through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum under any jurisdiction against NBF, its agents, vendors and process validators to claim any damages or relief or otherwise. NBF is not responsible for any loss or damage that you may suffer while participating in the Awards.

Others

> Nominations shall not contain any content that is defamatory, abusive and invasive of another's privacy or that infringes upon another person's copyrights or any
   other intellectual property rights or that is in any way objectionable.
> Nominees and winners permit free of cost the use of their name and factual information about their application and entry(s) in the public media (for the build-up to
   the awards, during the awards ceremony, etc) and do not have any right to any revenues earned through intellectual property rights generated by the Awards, if any.
> Awards management cannot and shall not be accountable / liable for any disruptions / stoppages / interruptions or cancellation of the awards.
> NBF and its contractors cannot be held responsible for matters out of its control and for force majeure reasons.
> Additions, deletions and / or modifications to these Terms and Conditions are at the discretion of the awards management and the awards management may
   make such additions / deletions and / or modifications, at any time.
> Nominators and Nominees agree that they shall hold harmless the Awards management, its employees, officers, contractors or other persons and shall defend
   them against any loss, claim, demands, costs, damages, judgments, expenses or liability arising out of or in connection with any or all claims whether or not
   groundless, that may be brought against the awards management by any third party in connection with participation in or winning the award.
> Awards management reserves the right to withdraw or amend the terms of the Awards at any time, with retrospective effect, and does not take the responsibility
   for any loss or damage that any person / organization / applicant / nominee may suffer as a result of the awards being withdrawn or its terms amended

The awards management shall endeavor, but not be liable, to the best of its ability to respond thereto.
> All disputes relating to or arising out of the awards shall be subject to the laws of India, and shall be subject to the exclusive jurisdiction of the courts of competent
   jurisdiction at Bengaluru, India.
